Blow to Governor Barchok as Court Reinstates the Fired CECs

Tough times are beckoning in County Government of Bomet as the Labour and Industrial relations court in Nairobi has temporarily reinstated the sacked CECs that served in the government of the late Governor Laboso and choked nomination or vetting of new appointees to take over pending the case in court.

A court order issued by Justice Byram Ongaya’s on 28th August 2019 that was certified as urgent and to be served by the close of the following day, temporarily barred Bomet County Assembly and Governor from replacing the fired CECs or interfering with their employment contracts or benefits.

According to a section read by The Rift News, any disobedience or non-observance of it will result in penal consequences to the respondents or any other person adding that its disobedience will lead to detention and punishments.   

The application pursued stopping the governor from removing them from office as well has to interfere with their employment contract, terms, and benefits. They also want the court stop any appointment or nomination of any person to their positions.

The court battle began after the last month’s decision by 37 members of the County Assembly to reject six CECs who had been nominated for reappointment to the administration of Governor Hillary Barchok.

According to the MCAs, the fired CECs were full of pride, incompetent, presided over the implementation of shoddy projects, lazy and lack of leadership skills.

Two CECs Benard Ngeno (Sports Youth and Social Services), and Justus Maina (Administration, ICT and Public Service) challenged the County Assembly decision in court on behalf of the other four colleagues through Kericho Governor Paul Chepkwony’s lawyer Mr. Peter Wanyama.

Others who were axed are Benson Sang (Water and Sanitation), Philip Sowek (Roads, Public Works, and Transport), Daisy Rono (Lands and Urban Planning) and Agriculture, Livestock and Cooperatives Julius Tuwei.

According to unnamed CEC who sought anonymity, the strategy emanated from the county boss who directed the county assembly selectively reinstate only three of them.

 If this is true, then Barchok interprets that her former boss hired the wrong people to the office. More is anticipated with the frosty relationship between the governor and CECs who are mandated to implement departmental service delivery. This means Bomet residents will suffer a lack of proper service delivery.

It is apparently clear that, with no prior political experience, Barchok is headed to political turmoil as this will attract interest among the local politicians vying for the gubernatorial seat come 2022.

The brewing battle pebble-dashing the office of the third Bomet Governor is expected to ground service delivery and implementation of the late Governor Joyce Laboso’s 2017 manifesto.

Before the appointment, Ngeno was a former Kapletundo MCA while Maina is a former DC at the cost who played a key role in the election of Nakuru County Governor Lee Kinyanjui. He had a chance in Nakuru but Governor Laboso knowing his value snatched him before being vetted in Nakuru.
